License Issues

A person charged with DWI in New York must be aware that several laws exist which, if applicable, call for the suspension of your driver's license pending prosecution.

DWI Penalties

DWAI - 1st Offense, DWAI - 2nd Offense, DWAI - 3rd and Subsequent Offenses, DWI - 1st Offense, DWI - 2nd Offense, DWAI Drugs, Felony DWI.

Test Refusals

In New York, there are two primary consequences of refusing to submit to a chemical test (e.g., a Breathalyzer test or a blood test).

Underage Offenders

If you are under 21 and you are found guilty of violating the "Zero Tolerance" law, your driver's license will be suspended for 6 months, and you will have to pay a $125 civil penalty.

Out-of-State Convictions

Where a New York licensee is convicted of operating a motor vehicle while under the influence of alcohol or drugs in another State, his/her driver's license will be revoked
